EClIPSE SERIES WARRANTY

Effective for Spas Sold after  August 25, 2005

STRUCTURE

TEN (10) years on the spa shell structure (by definition, the fiberglass or other material used to adhere to or support the interior surface material) only warranted against defects in material or workmanship and cracking if such cracking would affect usability of spa shell.

SURFACE

FIVE (5) years on the interior surface as applied to the spa shell is warranted against defects in materials and workmanship, blistering, and cracking.

PLUMBING

HAVEN SPAS warrants the plumbing parts and fittings used to comprise the system to be free from leaks and defects for a period of (2) years from original date of purchase.  Labor is covered for (2) years.

EQUIPMENT COMPONENTS

HAVEN SPAS warrants the factory installed pump(s), heater and controls against malfunction, leaking or defects in material or workmanship for a period of (4) years for parts,  and labor coverage for a period of (2) years from the effective warranty date. Pump seals are warranted for (1) year from effective warranty date. Factory brand covers are warranted for 1 year to be free from defects in material and workmanship.  Fiber optic or LED lighting is warranted against defects for a period of 2 years. Standard  tungsten light bulbs are not included in this warranty.  The use of BAQUA products will void the warranty on the Fiber optic or LED  light system and the jet bodies.  Light bulbs, head rests, fuses and filter cartridges are not included in this warranty, but are warranted to be free from defects in material and workmanship at the time of purchase. Attaching gaskets to or tightening unions to the pump(s), heater, or ozone system and gaskets are not covered under this warranty. CD/AM/FM player and speakers are covered by a separate warranty from the manufacture.  

WOOD PRODUCTS

HAVEN SPAS warrants the wood cabinet to be free from defects for a period of 90 days. Wood staining is excluded from coverage. Wood products require care and regular maintenance by the customer. In the event of a defect, the damaged wood piece, not the whole spa, will be repaired at the option of the manufacturer, and shall assume as its warranty period only the remaining time under this original 90 day warranty.  Any mechanical damage to the wood while in owners possession is not covered.

LIMITATIONS AND EXCLUSIONS

This warranty does not cover any repairs made by any persons or agencies other than HAVEN Spas, Inc. service
department, or an authorized HAVEN representative or an authorized service person. 

A$1.00 per mile repairman travel charge will be assessed if the spa is located outside your service agent's area.  If there is no qualified service company within 25 miles, you may be assessed travel charges

This warranty does not cover difficult access to the spa for repairs.  If the spa is not accessible, the service agent may require you to remove the obstacles in the way of servicing the spa.  Normal access: 1/ walking up to the spa with all sides accessible for service.  2/ If under or in a deck the decking in the way of access must be removed for service.  If the service agent is required to remove decking they will charge for that service, and are not responsible for any damage to the decking materials.

This warranty does not cover transportation costs of the entire spa or other consequential damages. 

Parts shipping policy: If  the part is covered under this warranty, shipping will be paid to the spa's location.  Spa owners are responsible for any return shipping of the parts.  If the defective parts are not returned within 30 days, then you will be charged for the new parts, shipping  and for the cost of the service.  There is no warranty coverage on parts shipped  if we do not receive the defective parts sent to our facility.  Your account will be credited when the parts are returned and you may not receive any further warranty service until these parts are returned and charges are paid.  Warranty is not a service policy, but only for repairs of defective original parts.

This warranty does not cover the cost of removal or installation of a spa or replacement spa.

This warranty does not cover fading of color, stains, or discoloration due to the improper use of chemicals or improperly maintained water chemistry or the use of Baqua products. Improper water chemistry could result in damage to support equipment or pose a possible health hazard.  Normal wear and tear is not covered.  Please follow our recommended water treatment methods.

This warranty does not cover damages caused or contributed to by accident, abuse, misuse, improper installation, exposure to fire or hazards of nature (example: earthquake or allowing the spa to freeze), and is limited to installations within the United States and Canada.

Except as expressly provided, there shall be no other warranty or obligations, express implied, oral or statutory, and in no event shall HAVEN, its agent, or employees be liable for injury or damage to any person for any claim of damage, however arising.

LEGAL RIGHTS

This Limited Warranty gives you specific legal rights. You may also have other rights which vary from state to state.
Some sates do not allow limitations on how long an implied warranty lasts, so this limitation may not apply to you.
Prompt return of a completed warranty registration form protects your warranty rights.

ASSIGNMENT This warranty is personal to and for the sole benefit of the original purchaser at the original site of
installation, and is not assignable.  If you move the spa and use our national moving service, your warranty will be transferable to the new location, but not transferable to another owner(s).  It is only for the original purchaser.

DISCLAIMER

SPA MUST BE COMPLETELY COVERED WITH AN INSULATING SPA COVER AT ALL TIMES WHEN NOT IN USE. FAILURE TO DO SO COULD CAUSE DAMAGE TO SPA SURFACE AND VOID THE WARRANTY. SPA MUST BE PLACED ON A SOLD, FLAT SURFACE THAT IS DESIGNED TO CARRY A MINIMUM OF 150 POUNDS PER SQUARE FOOT LOAD.

FAILURE TO DO SO COULD RESULT IN SURFACE SAGGING OR COLLAPSING WITH STRESS DAMAGE TO SPA, VOIDING THE WARRANTY. CRAZING OF SPA ACRYLIC TOP RAIL IS NOT COVERED UNDER WARRANTY.

PRO RATION WARRANTY

This is a pro-rated warranty for original owners of Haven "ELIPSE" Model Spas sold after Aug 25,2005 .  For as long as you own your Haven SE or SC Spa you will receive a 25% discount on any and all parts for your Haven SE or SC spa.  This discount is from the manufacturer's list prices for these parts and not against any  other sort of prices.  (For instance if you look in the WaterWay catalog 2005 the suggested price for a Stealth Blower 1.5 HP 240V is 172.57; making your price:  .75 times that or 129.43)

PLUMBING

HAVEN SPAS warrants the plumbing parts and fittings used to comprise the system to be free from leaks and defects for a period of :  As long as the spa is owned by the original purchaser.  As long as Haven Spas and The Spas Specialist  are in business.

EQUIPMENT COMPONENTS

HAVEN SPAS warrants the factory installed pump(s), heater and controls against malfunction, leaking or defects in material or workmanship for a period of , LIFETIME, as long as the original owner has the spa,  Pro-rated as specified in 1/ above,  for parts only, (No  labor coverage for this extended warranty.  This includes all parts,  Pump seals are warranted by this Pro-Rated warranty, However,   Factory brand covers ARE NOT warranted as part of this warranty, but you may purchase the brand of replacement cover, offered by The Spa Specialist inc.,  for the same discount.  Shipping for any parts included in the warranty are the spa owners responsibility.  This warranty does not require any returned parts.

Fiber optic lighting is warranted against defects for a period of this warranty . Light bulbs are included in this pro-rated warranty.

( The use of BAQUA products will void the warranty on the Fiber optic or LED  light system.) Light bulbs, head rests, fuses and filter cartridges are included in this warranty . All parts are included in this warranty at the 25% discount as long as those parts are still available..

WOOD PRODUCTS are included in this 25% lifetime discount.

LIMITATIONS AND EXCLUSIONS

There are no limitations or exclusions on this 25% discounted pro-rated warranty, unless the parts are no longer made, then this warranty is void.  It begins the day that your normal warranty as shown above ends.  All parts for your spa are to be sold to you for 25% discount against manufacturer's suggested retail prices, as long as you own your spa and Haven Spas, The Spa Specialist inc. are in business.
